Sexual Intercourse Law of the People's Republic of China

General Provisions
Article 1 This Law is formulated to regulate sexual intercourse, protect the legitimate rights and interests of the parties involved in sexual intercourse, maintain social order regarding sexual intercourse, and promote the widespread and healthy development of sexual intercourse under the socialist market economy.
Article 2 This Law applies to sexual intercourse activities within the territory of the People's Republic of China.
Article 3 Sexual intercourse activities shall comply with laws and administrative regulations and shall not harm the public interest.
Article 4 The right to sexual intercourse referred to in this Law means the right of a person to engage in sexual intercourse and to be engaged in sexual intercourse. A person exercising the right to sexual intercourse shall do so in accordance with legal procedures. The responsibility for sexual intercourse referred to in this Law means the time, money, and energy expended by the person engaging in sexual intercourse during the process.
Article 5 Parties to sexual intercourse may entrust their agents to act on their behalf and shall indicate their agency relationship during the intercourse. If a person engages in sexual intercourse without the authority of an agent but in the name of an agent, the agent shall bear the responsibility for the sexual intercourse; if the agent exceeds the scope of their authority, they shall bear the responsibility for the portion exceeding their authority.
Article 6 Sexual intercourse between persons without capacity for sexual intercourse or persons with limited capacity for sexual intercourse constitutes early romantic relationships and is invalid, but this does not affect the validity of other sexual intercourse. Citizens under the age of 14 lack the capacity for sexual intercourse.
Article 7: Anyone who obtains sexual intercourse through fraud or coercion, or who knowingly obtains sexual intercourse with malicious intent under the aforementioned circumstances, shall not enjoy the right to sexual intercourse.
Article 8: The person to whom intercourse is sought may not use the fact that they had sexual intercourse with a third party as a defense against the person to whom intercourse is sought. However, this does not apply if the person seeking intercourse is aware of the existence of a defense. A defense, as referred to in this law, means the act of the person to whom intercourse is sought refusing the person seeking intercourse's request for intercourse in accordance with the provisions of this law.
Article 9: The exercise of the right to sexual intercourse by both parties shall take place within the business premises of the parties involved; if the parties involved do not have a business premises, it shall take place at their residence.
Chapter 1 Seeking Intercourse
Article 10: A request for intercourse is an expression of intent made by the person seeking intercourse to the person to whom intercourse is sought, directly or indirectly, in various ways, requesting the person to whom intercourse is sought to grant a corresponding intention to intercourse.
Article 11: A request for intercourse must express the statement: "I want to have intercourse with you." A request for intercourse that does not express the matters stipulated in the preceding paragraph is invalid.
Article 12. When requesting sexual intercourse, the person expressing "how we became intimate," "how long we've been intimate," or "how deep our intimacy" must be clear and unambiguous. If the request does not specify "how we became intimate," it indicates love at first sight.
If the request does not specify "how long we've been intimate," their age at birth shall prevail. If the request does not specify "how deep our intimacy," the moon represents their heart.
Article 13. When requesting sexual intercourse, the person may express matters other than those stipulated in this law, but such matters shall not have the effect of requesting sexual intercourse.
Article 14. The person who requests sexual intercourse assumes responsibilities immediately upon requesting it.
Article 15 The right to sexual intercourse shall be extinguished if not exercised within the following periods:
(1) The right of the person seeking intercourse against the person being intercoursed shall be extinguished 9 years, 9 months, and 9 days from the date of the intention to intercourse;
(2) The right of the person seeking intercourse to seek recourse against the person being intercoursed shall be extinguished 4 years, 4 months, and 4 days from the date the request for intercourse is refused;
(3) The right of the person seeking intercourse to seek further recourse against the person being intercoursed shall be extinguished 1 year, 1 month, and 1 day from the date the right of recourse is refused. The
right of recourse referred to in this Law means the act of the person seeking intercourse to seek intercourse again against the person being intercoursed in various ways.
Article 16 The date of the person seeking intercourse to seek intercourse shall be determined by the person seeking intercourse in accordance with the law.
Chapter II Assignment
Article 17 A person having sexual intercourse may assign the right to sexual intercourse to another person or grant certain sexual intercourse rights to another person for exercise. If the person being intercoursed has stated that it is "not transferable," the sexual intercourse shall not be transferred.
Article 18 When exercising the rights stipulated in the first paragraph, the person with the right to sexual intercourse shall sign a contract and deliver it to the person being intercoursed.
Chapter Three Accepting a Proposal for Sexual Intercourse
Article 19 Accepting a proposal for sexual intercourse means that the person being proposed to sexual intercourse, after the person making the proposal, promises to provide the other party with equivalent sexual intercourse intentions.
Article 20 The person being proposed to sexual intercourse shall accept or refuse the proposal within three days from the date the person making the proposal.
Article 21 The person being proposed to sexual intercourse may not attach conditions to accepting the proposal; if the acceptance is conditional, it shall be deemed a refusal of the proposal.
Article 22 If the person being proposed to sexual intercourse refuses the proposal, they shall state the reasons for the refusal to the person making the proposal. The person making the proposal may exercise the right of recourse and the right of further recourse in accordance with the law.
Chapter Four Heartbreak
Article 23 Heartbreak is the loss of sexual intercourse with the person one has been sexually intercourse with, or the person one has been sexually intercourse with no longer sexually intercourse with one.
Article 24 After a breakup, a person who has engaged in sexual intercourse may, in accordance with the law, do the following:
1) Lock themselves in their room, cover their head with a blanket, and sleep for several days and nights; suitable for mild breakup.
2) Shave their head and become a nun (or monk); suitable for moderate breakup.
3) Stand in the biting north wind, burying their face in their hands and grieving over the Great Wall; suitable
for moderate breakup. 4) Blindfold themselves with a black cloth and jump off the Xiangjiang Bridge—"having just drunk the water of Changsha, they become Wuchang fish"; suitable for severe breakup.
5) Tie one end of a rope to a tall tree and the other end to their neck, to give morning exercisers a small surprise; suitable for severe breakup.
Other actions besides those stipulated in this law may be taken during a breakup, but these are not protected by law.
Chapter 5 Application of Law to Sexual Intercourse Involving Foreign Parties
Article 25 The application of law to sexual intercourse involving foreign parties shall be determined in accordance with the provisions of this chapter. The term " international sexual intercourse" as used in
the preceding paragraph refers to acts such as seeking sexual intercourse, refusing sexual intercourse, sexual intercourse, and heartbreak, which occur both within the territory of the People's Republic of China and outside the territory of the People's Republic of China. Article 26 Where an international treaty concluded or acceded to by the People's Republic of China contains provisions different from those of this Law, the provisions of the international treaty shall apply. However, this does not apply to clauses on which the People's Republic of China has declared reservations. Where this Law and international treaties concluded or acceded to by the People's Republic of China do not provide for a matter, international custom may apply . Article 27 Acts such as seeking sexual intercourse, refusing sexual intercourse, sexual intercourse, and heartbreak shall be governed by the law of the place where the act occurred. 　　　　　　　　　　　　 Chapter VI Legal Liability Article 28 Anyone who commits any of the following acts of sexual fraud shall be held criminally liable according to law: (1) Fraudulent sexual intercourse to obtain property; (2) Malicious transfer of sexual intercourse; (3) Impersonating another person for sexual intercourse to obtain sexual intercourse or property; Article 29 Anyone who commits any of the acts listed in the preceding article, whose circumstances are minor and do not constitute a crime, shall be given administrative penalties in accordance with relevant national regulations. 　　　　　　　　　　　 Chapter VII Supplementary Provisions Article 30 The specific implementation measures for the management of sexual intercourse shall be formulated by the Ministry of Civil Affairs and the Chinese People's Sexual Intercourse Committee in accordance with this Law and implemented after being approved by the State Council. Article 31 This law shall come into force on the date of the Sexual Liberation Day in 8003.
