A female homeowner developed a romantic relationship with a construction worker during her home renovation and had sexual relations with him multiple times. He secretly filmed these sexual encounters with the homeowner and then used the videos to blackmail her for a large sum of money. The Huizhou Intermediate People's Court upheld the original verdict, finding him guilty of extortion and sentencing him to three years and seven months in prison.

The man, surnamed Rong (pseudonym), 26 years old, from Sichuan,

with a junior high school education, worked as a construction worker in Huizhou. He was divorced and had a young daughter. According to the judgment, the victim lived in an upscale residential area in Huizhou. She met Rong during her home renovation, and they developed a romantic relationship, having sexual relations multiple times. Afterwards, Rong borrowed 30,000 yuan from the victim. He also had sexual relations with the victim's daughter and borrowed 33,000 yuan from her as well.

Following this, Rong frequently borrowed money from the victim under various pretexts, during which time he also secretly filmed these sexual encounters.

Not content with this, Rong demanded that the victim buy him a car worth over 100,000 yuan or pay him cash of equivalent value. To blackmail the victim and achieve his extortion goal, Rong also sent explicit videos to the victim and her daughter. Rong claimed that he would return the videos and end their relationship after achieving his goal; otherwise, he would send them to the victim's relatives and friends. Left with no other option, the victim agreed.

However, the very next day, Rong changed his mind, claiming he would also forgive 66,000 yuan of the debt. The victim immediately reported him to the police. Rong was arrested by the police while waiting to collect the money in front of a bank.

The Huicheng District Court found Rong guilty of extortion in the first instance and sentenced him to three years and seven months in prison, with a fine of 5,000 yuan.

Rong appealed, arguing that the relationship with the victim was consensual and that the videos were for his own amusement. He claimed that he originally intended to sell his house to the victim to offset the debt, and then receive over 100,000 yuan in cash or a car of equivalent value in return. Rong claimed it was a fair transaction.

The Huizhou Intermediate People's Court, in its second-instance judgment, stated that Rong refused to plead guilty, the nature of his crime was egregious, and he should be severely punished. However, because his extortion was unsuccessful, he was punished more leniently than if the extortion had been completed. The first-instance judgment was correct. The court ruled to dismiss Rong's appeal and uphold the first-instance judgment.
